Terms and conditions

These terms and conditions (T&C) apply to all services Surfaced (hereinafter "contractor") provides to customers (hereinafter "client"). Differing terms of the client are not valid unless the contractor expressly agrees in writing.

Surfaced provides services in Generative Engine Optimization (GEO) and Answer Engine Optimization (AEO) in the form of packages, billable monthly or quarterly:

All content is provided ready to implement; implementation on the client's website is done by the client. Surfaced does not guarantee any particular placement in AI systems (see point 8). Changes or extensions require a written agreement.

• AI-Visibility Monitoring (€99/month or €199/quarter): AI visibility check per billing period, error and opportunity list, technical quick check plus 1–2 ready-to-implement corrections and a report.
• AI-Visibility + Anleitung (€250/month or €499/quarter): monitoring services, plus step-by-step guides, a prioritized list, ready-made llms.txt/robots.txt and 3–5 texts/corrections per report.
• AEO Premium (€499/month or €990/quarter): guide services, plus Deep Research of all external sources, llms.txt and schema markup (continuously updated), mention and competitor monitoring and a quarterly strategy.

Offers from Surfaced are non-binding. A contract is concluded only through Surfaced's written order confirmation or the start of service delivery. Verbal side agreements require written confirmation.

All stated prices are exclusive of VAT. Statutory VAT is charged separately at payment. Invoices are payable within 14 days of the invoice date without deduction.

In case of late payment, default interest of 5% above the base rate per year is charged. Surfaced reserves the right to suspend ongoing services in case of late payment.

The client undertakes to provide all information, access (e.g. CMS, hosting, Google Search Console) and materials necessary for service delivery in a timely and complete manner.

Delays arising from a lack of cooperation by the client are not at Surfaced's expense. Agreed deadlines extend accordingly.

After full payment of the agreed fee, the client receives the simple, non-transferable right of use to the created content (texts, schema markup, llms.txt, etc.) for the agreed website.

Surfaced reserves the right to cite services rendered as a reference in anonymized form, unless the client expressly objects.

Both parties undertake to keep confidential all confidential information of the other party learned during the collaboration and not to pass it on to third parties. This obligation also applies after the end of the contractual relationship.

Surfaced is liable for damages only in cases of intent and gross negligence. Liability for lost profit, indirect damages or consequential damages is excluded.

Surfaced gives no guarantee for particular placements or mentions in AI systems (ChatGPT, Perplexity, Google AI, etc.), as these are operated by external providers over whose algorithms Surfaced has no direct influence.

The packages are billed monthly or quarterly at the client's choice and have a minimum term of 3 months from the start. This minimum term accounts for the fact that AI visibility measures only take measurable effect over several crawl and update cycles of the AI systems.

After the minimum term, the contract extends indefinitely and can be cancelled by both parties at any time as of the end of the current billing period — informally, e.g. by email or via the Stripe customer portal. An already paid period is not refunded pro rata. The statutory right to extraordinary termination for good cause remains unaffected.

Surfaced is entitled to adjust the prices of ongoing subscriptions for future billing periods. A price change is announced at least six weeks before it takes effect in text form.

During an ongoing minimum term and an already paid billing period, the agreed price remains unchanged. If the client does not agree to the change, they have a special right of cancellation.

Personal data is processed in accordance with the GDPR and the Austrian Data Protection Act (DSG). Details can be found in our privacy policy.

Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction for all disputes is Surfaced's registered office in Austria, where legally permissible.

Should individual provisions of these T&C be or become invalid or unenforceable, the validity of the remaining provisions remains unaffected. The invalid provision shall be replaced by a valid one that comes closest to the economic purpose of the invalid provision.
